Legal Experts: HP Could Be Fighting A Losing A Battle In Blocking Mark Hurd’s Appointment At Oracle Corp
The saga of ex-CEO, Mark Hurd and the fallout with Hewlett Packard over the forced resignation of Mr. Hurd has taken yet another turn as HP has now filed a lawsuit against Mr. Hurd in an effort to block his appointment as the co-President of Oracle Corporation. Stating that, Mr Hurd has been privy to sensitive information while performing the duties of CEO, HP has asked the Santa Clara County Superior Court. California to overturn Mr. Hurd's latest appointment.
However, legal experts from the state of California have expressed skepticism in regards to the successful blocking of Mark Hurd's appointment, as California allows anyone to switch their jobs from one company to another in their own field of expertise, regardless of the position held in the previous company. One of the major rivalry between the big hitters in the technology world including HP, Apple Inc., Microsoft Corp., International Business Machines Corp. and Google Inc. has been their efforts to block the efforts of their senior management officers to switch to each other's rivals, as all these companies are afraid to losing sensitive information and trade secrets. On a similar story, the long time ally of Mark Hurd and the CEO of Oracle Corporation, Larry Ellison has said that, the lawsuit filed against Mr. Hurd by HP is entire vindictive and that, such moves on part of HP could lead to souring of relations between the two technology giants.
According to Mr. Ellison,
"Oracle has long viewed HP as an important partner. The HP board is acting with utter disregard for that partnership, our joint customers, and their own shareholders and employees. The HP Board is making it virtually impossible for Oracle and HP to continue to cooperate."
Experts also believe that, neither the court would overturn Mr. Hurd's appointment nor would it enforce a noncompete agreement and would most definitely require HP to provide concrete and adequate proof to substantiate their claims that, Mr. Hurd can in fact use these trade secrets against HP.
